Government delates compliance with RenovaBio targets from 2022 to September 2023

Less than a week after the RenovaBio Committee, linked to the Ministry of Mines and Energy (MME), recommended the extension to 2023 of the deadline for meeting the individual decarbonization goals of 2022 by fuel distributors, the suggestion was accepted. The decree effecting the postponement was published in the Official Gazette (DOU) on Friday, 22.
Decree No. 11,141, signed by President Jair Bolsonaro, amends decree no. 9,888 of 2019, and determines that distributors have, exceptionally, until September 30, 2023 to prove compliance with their individual goals of 2022, and no longer until December 31 of this year.
In addition, for the next few years, proof of the acquisition of the credits for compliance with the annual obligations should take place by March 31 of the following year.
The MME declared, before the change, that the measure is "inserted in the current context of the state of emergency in Brazil, resulting from the extraordinary and unpredictable rise in prices of oil, fuels and their derivatives and the social impacts arising from it".
In practice, the action aims to try to contain the escalation of prices of CBios that exceeded R $ 200 in June. With this, the government also intends to create an additional reduction in the price of diesel and ethanol in the pumps.
On the subject, the president of the Sugarcane Industry Union (Unica), Evandro Gussi, assessed this week that the postponement of the deadline for meeting individual compulsory targets would have no legal basis.
